The Revised Proposed Final Judgment (RPFJ) against Google introduces new measures aimed at enhancing competition, particularly in search and advertising markets. Here’s what’s new and why it matters.

What’s New in the Revised Judgment?

AI Investments Regulation:

Instead of a total ban on Google’s AI investments, the RPFJ now requires Google to provide prior notification before making any future AI-related investments. This change aims to ensure transparency without stifling technological advancement.

Google shall provide prior notice of any proposed AI-related acquisitions exceeding a certain threshold.

Chrome Divestiture Requirement:

Google must divest its Chrome browser, providing competitors with fair access to a critical gateway for search distribution. This aims to reduce Google’s control over search defaults and enhance competition.

Ad Syndication Relief Changes:

The previous requirement for immediate marginal-cost pricing for search text ad syndication has been removed. The focus is now on ensuring parity, transparency, and control for advertisers and competitors.

The revised judgment removes immediate pricing requirements but emphasizes fair access for advertisers.

Clarified Self-Preferencing Rules:

Adjustments made to prevent Google from leveraging its ecosystem to disadvantage rivals and clarify previous ambiguities in enforcement.

Provisions have been refined to prevent Google from self-preferencing in a manner that undermines fair competition.

Improved Data Sharing Requirements:

Enhanced requirements for sharing data access and improving transparency for advertisers and competitors, ensuring a fairer environment for advertisers.

Google shall provide third-party access to relevant advertising data under standardized terms

What It Means for Advertisers

The revised judgment aims to create a fairer playing field for advertisers by providing them with better access to data, improving transparency, and minimizing Google’s monopolistic practices. Ensuring parity in ad syndication and preventing Google from leveraging its ecosystem are significant steps toward increased competition.
